By accessing or using Huestoric (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Huestoric provides AI‑powered photo restoration, enhancement, and colorization. The Service enables you to upload photographs, select processing options powered by various AI models, and securely download the resulting outputs. Results may vary based on source image quality and the chosen processing options.

3. User Accounts

3.1 Account Creation

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

3.2 Account Security

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use or suspected breach of security.

3.3 Age Requirements

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service.

4. Acceptable Use

4.1 Permitted Use

You may use Huestoric to:

• Process personal and family photographs
• Restore historical images for personal, educational, or commercial purposes
• Enhance and colorize photographs you have the right to use and modify

4.2 Prohibited Content

You agree NOT to upload, process, or distribute content that:

• Contains explicit sexual or pornographic material
• Depicts graphic violence, gore, or content intended to shock or disgust
• Promotes or depicts illegal activities
• Contains child exploitative material of any kind
• Infringes intellectual property or privacy rights
• Contains malware, viruses, or malicious code
• Is fraudulent, deceptive, or misleading
• Promotes hatred, discrimination, or violence against individuals or groups

4.3 Model Restrictions & Moderation

Important:

Certain third‑party AI models integrated in the Service may reject or restrict content involving weapons, drug use, nudity/sexual content, or violence/injury, among other sensitive categories. Legitimate historical photos may occasionally be flagged. If you believe content was wrongly rejected, contact support.

4.4 Prohibited Activities

You agree not to:

• Use the Service in violation of any law
• Attempt to bypass content filters or technical restrictions
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service or its infrastructure
• Resell, sublicense, or redistribute access except as expressly permitted

5. Credits & Payment

5.1 Credit System

The Service operates on a credit‑based model. Each processing job consumes credits according to the selected model and options.

5.2 Subscriptions

Subscription plans provide monthly credits that refresh each billing cycle. Unused monthly credits expire at the end of the cycle and do not roll over. Subscriptions renew automatically until canceled.

5.3 Credit Packs

Credit packs are additional credits available for purchase. Important: Credit packs require an active subscription to purchase and use. All credit pack credits will be removed from your account when your subscription ends or is cancelled. When you have both monthly and non‑expiring credits, monthly credits are used first; credit pack credits are consumed afterward.

5.4 Refunds

Due to computational costs, credits (including subscription allocations and credit packs) are generally non‑refundable once purchased or used. Limited credit compensation may be issued for technical failures or demonstrably legitimate historical content incorrectly rejected by model filters, at our sole discretion.

5.5 Pricing Changes

We may modify pricing and plan features. If you are an active subscriber, we will provide advance notice of material price changes before they take effect.

6. Intellectual Property

6.1 Your Content

You retain ownership of images you upload. You grant Huestoric a limited, non‑exclusive, revocable, worldwide license to host, process, and transmit your content solely to provide the Service and related support.

6.2 Representations

You represent that you have all rights necessary to upload and process the content and that your use will not infringe any third‑party rights.

6.3 Our Materials

The Service (excluding user content) — including software, workflows, design, trademarks, and branding — is owned by Huestoric and protected by applicable laws. No rights are granted except as expressly set out in these Terms.

7. Privacy & Security

Your use of the Service is subject to our Privacy Policy. We use private, access‑controlled storage and expiring signed links for downloads. We do not use your photos to train AI models.

8. Availability & Disclaimers

8.1 Service Availability

We strive to provide a reliable Service but do not guarantee uninterrupted or error‑free operation. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

8.2 AI Output

AI outputs may vary and are not guaranteed to meet specific expectations. Output quality depends on numerous factors, including input quality and selected options.

8.3 Limitation of Liability

To the maximum extent permitted by law, Huestoric will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill. In no event will our aggregate liability exceed the greater of (a) US$100 or (b) the amounts you paid to us for the Service in the six months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Huestoric and its personnel from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms.

10.1 By You

You may terminate your account at any time in your account settings.

10.2 By Us

We may suspend or terminate your account for violations of these Terms or if your use poses risk to other users, our infrastructure, or third parties.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict‑of‑laws rules. Any dispute will be resolved by binding arbitration in Virginia under the applicable rules of the American Arbitration Association. You and Huestoric waive the right to a jury trial and to participate in class actions.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Your continued use after the effective date of changes constitutes acceptance of the updated Terms.
